National Counsel for Gadolinium Retention Contrast Dye Litigation
Kendall PC serves as national counsel to Guerbet LLC and Liebel-Flarsheim Company, LLC in nationwide litigation regarding Guerbet’s Optimark® contrast dye. Plaintiffs claim that they developed various injuries as a result of retaining gadolinium in their bodies following use of Optimark and other contrast agents during MRI procedures.
- In re Gadolinium-Based Products Liability Litigation. Jamie Kendall argued for Guerbet and Liebel-Flarsheim before the Judicial Panel on Multidistrict Litigation. Plaintiffs’ petition to create an MDL was denied by the Judicial Panel.
- Munnuru v. Guerbet, LLC, et al.,Fischer v. Bayer Healthcare Pharmaceuticals, Inc., et al and Davis v. McKesson Corporation, et al. Jamie Kendall argued on behalf of all manufacturing defendants to exclude one of plaintiffs’ experts. Brad Welsh assisted with the Daubert briefing.
On August 2, 2019, Judge David Campbell in the U.S. District Court for the District of Arizona granted Defendants’ Daubert motions to exclude all of the plaintiffs’ experts from offering medical causation opinion testimony. The Court found in pertinent part that plaintiffs’ causation experts did not present reliable scientific principles and methods, or apply accepted principles and methods reliably, to show that their theories have been validated. This was a significant victory for Guerbet and Liebel-Flarsheim.
